Responsibility of neglect to comply with the Rules

  • Rule(s) to be applied: Rule 2 (Responsibility)
  • Applying the Rule(s) and comments: In accordance with Rule 2 (a) (Responsibility), nothing in these Rules shall exonerate any vessel, or the owner, master or crew thereof, from the consequences of any neglect to comply with these Rules or of the neglect of any precaution which may be required by the ordinary practice of seamen, or by the special circumstances of the case.
    Comments:
    Rule 2 (a) (Responsibility) is widely known as the rule of good seamanship.
    Responsibility for applying the Rules is on the vessel, owner, master or crew.
    Ordinary practice of seamen is usually defined as a result of a behaviour which can be expected from an average good master or seafarer. Such master or seafarer carefully and conscientiously fulfils his duties.
